Once you’ve selected an aircraft, a Letter of Intent (LOI) outlines the purchase terms, such as price, deposit, inspection terms, and offer expiration. An aviation attorney may assist in drafting the LOI to ensure both parties agree on the primary terms.
If the offer is accepted, a 5%-10% deposit is made to an escrow company in Oklahoma City, which holds the funds while the transaction progresses. This deposit shows your commitment to the purchase.
An Aircraft Purchase Agreement (APA) details the terms, including price, deposit conditions, inspection timing, and warranties. It’s advised to use a specialized broker or aviation attorney to avoid legal pitfalls unique to aircraft transactions.
A comprehensive pre-buy inspection at a trusted maintenance facility ensures the aircraft’s condition. Any discrepancies found will be negotiated between buyer and seller, with the seller typically covering repairs for airworthy discrepancies.
Once discrepancies are resolved, the buyer executes a Technical Acceptance, confirming their commitment to purchase, and the deposit becomes non-refundable.
After the purchase, plan the aircraft's maintenance, storage, and legal requirements, including pilot training and insurance. You may also choose to charter the aircraft to offset operating costs. An aircraft management company can handle many post-closing logistics.
